Terms of Service

LetterToHer is operated by [CONFIRM: operating legal entity name], [CONFIRM: registered address] (“we”, “us”). By creating an account or using LetterToHer you agree to these terms and to our Privacy Policy. You must be at least 18 years old and able to enter into a binding contract.

LetterToHer stores letters you write to the people you love and delivers them by email after our careful-delivery process concludes that you have passed away. That process relies on your check-ins and on the trusted contacts you name. It does not rely on official death certification, and we cannot guarantee that a letter is delivered at any particular time, or at all. LetterToHer is not a will, not a legal estate document, not a way to transfer assets, and not an emergency service. Please read our legal understanding page, which you also confirm before a letter enters careful delivery.

Keep your login details private and your email address and phone number current, because check-ins reach you there. You are responsible for everything done through your account. One account per person; you may not use someone else’s account or create one for a person who has not agreed to these terms.

When you add a loved one or a trusted contact you give us their name and contact details. You confirm that you may share those details with us for this purpose, that the person would reasonably expect to hear from us on your behalf, and that you will keep them up to date. Trusted contacts will be asked to help confirm whether you are okay; loved ones will receive their letter only after careful delivery concludes. Either may decline, and either may report a concern to us.

You own what you write and upload. You give us only the limited permission we need to store, encrypt, process and deliver it as this service describes. You may not use LetterToHer to threaten, harass, defraud or impersonate anyone, to distribute unlawful material, or to send content to a person who has asked not to receive it. We may pause a letter, review it through our report-a-concern process, and remove content or close an account that breaks these rules.

Free includes one letter for one loved one and monthly check-ins by email. Plus costs US$3 a month billed monthly, or US$30 a year billed yearly, in advance through Stripe, our payment processor, and renews automatically until you cancel. You can cancel at any time from your billing page; Plus stays on until the end of the period you have paid for, then your account returns to Free. Nothing you have written is deleted when that happens; only what you can add is limited. Payments are not refunded for a partial month or year except where the law requires it. We will give you at least 30 days’ notice by email before a price changes.

You can delete your account from your settings. It is recoverable for 30 days, after which your letters, attachments and the people you added are permanently deleted. Letters already delivered cannot be recalled. Letters that were in careful delivery are cancelled.

We may change LetterToHer over time. We may suspend or close an account that breaks these terms or that puts other people at risk. If we ever have to discontinue the service we will give you reasonable advance notice by email so you can act on your letters first.

LetterToHer is provided as it is. We work hard to keep it running and to deliver letters only when we should, but we cannot promise it will be uninterrupted, error-free, or that every letter will reach its recipient. To the fullest extent the law allows, our total liability to you for any claim connected with the service is limited to the amount you paid us in the 12 months before the claim arose, and we are not liable for indirect or consequential losses. Nothing in these terms limits liability that cannot be limited by law.

These terms are governed by [CONFIRM: governing law and courts, e.g. the laws of British Columbia and the courts of Canada].

When we change these terms in a way that matters we will tell you by email or inside the app before the change takes effect. Continuing to use LetterToHer after that means you accept the new terms. Questions, complaints or concerns can be sent through our report a concern form.
